Data disagreement: How efforts to regulate data privacy is fragmenting the development of Artificial Intelligence

The latest news and debates surrounding Artificial Intelligence (AI), particularly since the launch of ChatGPT in November 2022, have increased existing fears regarding its potential economic and social impact, leading to greater interest in regulating, or even containing, its development. However, AI is only the visible part of a digital value chain, in which access to data is critical. Without data, AI would not have raw material to process; without AI, data would have no value. Most of the data used by AI algorithms is cross-border in nature, hence a global governance framework is required. However, the lack of global consensus on the scope of data regulation is leading to fragmented regulatory approaches, restricting the technological interoperability, particularly between the United States, China and the European Union. This article argues that the formation of these data silos will result in a differentiated development of AI and will have an impact on the strategic competition between the United States and China for global technological supremacy. Meanwhile, sooner or later, less technologically advanced countries will have to take a position supporting one of those visions, with possible consequences for some of them in their economic and social development.
